Small Claims Basic Facts.

Can’t find District Division-Hillsborough? Even though the town of Hillsborough is situated in Hillsborough County, the Hillsborough court is listed as a location in this program under 6th Circuit-Merrimack County. When you select 6th Circuit - Merrimack County in the Where to File option above, you will then be able to select the District Division-Hillsborough location option in the drop down menu.

Refer to NH RSA 503 or District Division Rules for Small Claims Actions.

How do I know which Circuit to select?

The NH Circuit Court is divided into 10 circuits, starting at the top of the state. Click here for a map showing the 10 Circuits. The Circuits correspond to NH Counties. The 1st Circuit is Coos County, the 2nd Circuit is Grafton County, and so on down the state. Click here to find your court.

How do I know which location to select?

The claim shall be filed in the District Division where either the Plaintiff or the Defendant resides. If the Defendant is not a resident of New Hampshire, the claim may be filed in the court of any town or district where the Defendant, in person or through an agent, transacts business; makes a contract with a resident of the town or district; commits a tortious act; or owns, uses or possesses any real property. To find which court covers your particular town, please here. If one of the parties in the case is an estate, trust, guardianship or conservatorship, the case may be filed in the Probate Division in the county where the estate, trust, guardianship or conservatorship is located. Electronic filing in the Probate Division is not yet available.
